Terms and Conditions

Thank you for signing up for your private paint party with Traveling Paints.

I. These Terms and Conditions (the “Terms”) govern your use of Traveling Paints services, as well as the use of the Traveling Paints service by all Event Attendees, including all features of Traveling Paints website, user experience, all content associated therewith, and your Event (collectively “Traveling Paints”). By using, visiting, or browsing the Traveling Paints, you accept and agree to be bound by these Terms.
II. HOW A TRAVELING PAINTS PAINT PARTY SERVICE WORKS: The Traveling Paints is an entertainment service that will provide you with an evening of painting instruction at the venue of your choice. Traveling Paints reserves the right in its sole and absolute discretion to make changes from time to time and without notice in how Traveling Paints operates the Service and Materials Provided. Traveling Paints will provide all paints, canvasses, stencils, brushes, dotting tools, and aprons (“Equipment”) necessary to accommodate the number of Event Attendees that you have selected. To the extent there will be in excess of fifteen Event Attendees, you must inform Traveling Paints of the number of additional Event Attendees at least forty-eight hours in advance of the Event, in order to allow for the proper number/amount of supplies to be at the Event. While Traveling Paints maintains quality control over the materials it uses, the quality of the paint, canvasses, brushes, stencils, and aprons may vary from event to event, and venue to venue, and may be affected by a variety of factors. Traveling Paints does not provide tables and chairs for events. End result. Traveling Paints makes no representations or warranties about the quality of the painting of Event Attendees or the individual experiences of Event Attendees. Every painting will be unique and ‘your own’, therefore, there is no reason to believe that your work will be an exact duplicate of the one you choose to do, Traveling Paints will make every effort to begin the instruction at the designated start time and complete the instruction between 2-3 hours. However, the time it takes to begin and complete the instruction will vary based on a number of factors, and Traveling Paints makes no representation as to the exact amount of instruction time at the Event. Capacity Limitations. The venue of your choice may have capacity limitations for the Event. Traveling Paints will confirm that the venue you choose has capacity for the number of guests you originally schedule for the Event. You must provide a final headcount to Traveling Paints at least 48 hours prior to your Event. To the extent you increase the number of Event Attendees after you originally schedule the Event, there may not be enough space to accommodate the increased number. Traveling Paints requires that you arrive at the venue 30 minutes prior to the start of the Event.

III. AIR QUALITY: Do to health allergies there will be NO PLUGINS, CANDLES OR OTHER MELTING SCENTS of any kind 30 minutes to Traveling Paints arrival through the end of event or until TRAVELING PAINTS has left the venue.

IV. INCLEMENT WEATHER: Traveling Paints reserves the right to cancel or reschedule any event due to a hurricane, tropical storm, tornadoes, severe flooding, ice storm, or any other unsafe driving conditions to the painting event.

V. BILLING: Traveling Paints Event fee varies per person (with a minimum of 8 people) from event chosen. Additional charges may apply outside of Santa Rosa county. To book an Event, there will be at least 50% deposit required to secure your date. Traveling Paints will set up a payment link where you can submit payment via credit card. Your payment is refundable (as a credit towards a future event) if you cancel more than 15 days before the Event, but in such case you may only reschedule your Event once. Payment is not refundable if your Event is cancelled within 15 days of the Event.

VI. RIGHT TO TERMINATE END USER LICENSE AGREEMENT: BY USING THE TRAVELING PAINTS SERVICE, YOU ACKNOWLEDGE AND AGREE (1) TO TRAVELING PAINTS END USER LICENSE AGREEMENT FOUND HERE AS SUCH MAY BE AMENDED OR ADDED TO FROM TIME TO TIME AND (2) TO RECEIVE, WITHOUT FURTHER NOTICE OR PROMPTING,UPDATED VERSIONS OF TRAVELING PAINTS PARTY AND RELATED THIRD-PARTY. IF YOU DO NOT ACCEPT THE FOREGOING TERMS, PLEASE DO NOT USE OUR SERVICE. We do not warrant that any of the events or materials used in connection with our service nor do we warrant that operation of our service.

VII. LIABILITY WAIVER: In no event should Traveling Paints or any of its managers, members, agents, instructors, assistants, and successors or assigns be liable, jointly or severally, to you for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss, whether advised of the possibility of damage, and on any theory of liability, arising out of registering for and/or attending a Traveling Paints event.

VIII. SOCIAL MEDIA: You can connect Traveling Paints to your Facebook or other social media accounts (“Social Media Accounts”). If you choose to connect your account with any Social Media Accounts, you will be able to take advantage of various social features Traveling Paints may already have, or will be creating, as part of Traveling Paints, as well as features available on Facebook. These features will be designed to share information with others - the essence of social media.
